You're reviewing payroll for the week and notice one of your crew worked last Sunday. Sunday is his rest day. You paid him his regular daily rate. But his co-worker, whose rest day is Wednesday, also worked on her rest day and got the same flat rate. Neither got the premium they're owed under the Labor Code, and if DOLE comes knocking, that's a problem.

Rest day pay catches a lot of small business owners off guard because the rule itself is simple, but the combinations with holidays and overtime are not.

What counts as a rest day

Under Article 91 of the Labor Code, every employee is entitled to at least 24 consecutive hours of rest after every six consecutive working days. The specific day depends on your agreement with the team member or your company schedule.

For office-based businesses, it's often Sunday. For restaurants, retail shops, and businesses that operate seven days a week, rest days vary by person. One staff member might have Tuesday off while another has Thursday. The rest day is whatever the schedule assigns, not automatically Sunday.

The 1.30x premium

When a team member works on their designated rest day, they earn a 30% premium on top of their regular daily rate.

Rest day pay = daily rate x 1.30

A team member earning ₱500/day who works on their rest day earns ₱500 x 1.30 = ₱650 for the first eight hours. Overtime beyond that carries an even higher rate (1.69x of the hourly rate).

When rest days collide with holidays

This is where the math gets interesting. The rest day premium stacks with holiday premiums. It's not one or the other.

Rest day + regular holiday

When a regular holiday (Christmas Day, Independence Day, Rizal Day) falls on a team member's rest day and they work, the rates combine.

Rest day + regular holiday = daily rate x 2.60

For the ₱500/day team member: ₱500 x 2.60 = ₱1,300.

If they don't work, they still receive 100% of their daily rate for the regular holiday, as long as they were present or on approved leave the workday before.

Rest day + special non-working holiday

When a special holiday (Ninoy Aquino Day, Black Saturday) falls on a rest day and the team member works, the combined rate is 150%.

Rest day + special holiday = daily rate x 1.50

For the ₱500/day team member: ₱500 x 1.50 = ₱750.

If they don't work, the default rule is no work, no pay. Special non-working days don't guarantee pay for unworked hours unless your company policy says otherwise.

Common mistakes

Treating Sunday as everyone's rest day. If your restaurant staff have staggered rest days but your payroll treats Sunday as the rest day for all, you're computing premiums incorrectly for anyone whose rest day is a different day.

Forgetting the stacking rules. A team member who works on a regular holiday that is also their rest day gets 2.60x, not 2.00x and not 1.30x. Both premiums apply.

Skipping holiday pay on unworked rest days. Even if a regular holiday falls on a rest day and the team member doesn't work, they're still entitled to 100% of their daily rate. This catches many owners off guard.

No schedule documentation. Without a written schedule showing each person's rest day, disputes about whether a day qualified for the premium become impossible to resolve. DOLE will ask for documentation.
